ARTICLE 1 – SCOPE - ACCEPTANCE BY THE CUSTOMER
The General Conditions of Sale give details of the conditions for orders, payment, delivery and any returns of Products ordered by customers acting in a non-professional capacity through Masha Keja website. The General Conditions of Sale are accessible at any time on Masha Keja website. The fact of a Customer ordering through the Masha Keja website infers their full acceptance of and compliance with the General Conditions of Sale, which is expressly accepted by the Customer, who renounces, in particular, availing themselves of any document to the contrary which would thus be unenforceable against Masha Keja SARL.
ARTICLE 2 - PRODUCT ORDERS
Any order placed on the MASHAKEJA.COM site constitutes a contract concluded remotely between the Customer and Masha Keja SARL , and necessarily implies irrevocable acceptance by the Customer, without restrictions or reserves, of the General Conditions of Sale. The website MASHAKEJA.COM presents the features of products proposed for sale to allow Customers to be informed about the Products that they wish to buy before placing an order. In particular, the site MASHAKEJA.COM describes the specifications, illustrations, indications or dimensions of products. The choice and purchase of a Product is placed under the sole responsibility of the Customer. Photographs and graphics for Products proposed for sale are as an indication only and do not incur the liability of Masha Keja SARL in any way whatsoever. Product offers shall be construed as within the limits of available stocks. Indications concerning the availability of Products are provided when the order is placed. The sale shall only be considered as definitive after the sending by Masha Keja SARL to the Customer of confirmation of acceptance of the order by email and after the full amount of the price to be paid has been received and cashed by Masha Keja SARL . ARTICLE 3 - PRICE AND TERMS OF PAYMENT
Prices are indicated in Euros on the MASHAKEJA.COM website. They include any reductions as well as V.A.T. applicable on the day of the order, but exclude delivery charges. Products are supplied at the prices in force on the day that acceptance of the order is confirmed by Masha Keja SARL , established in particular according to the prices practiced by its supplier, as communicated to the Customer prior to placing of the order. The price indicated in the order confirmation by Masha Keja SARL is the definitive price. When ordering, Customers are invited to ensure that the price of Products to which they are referring corresponds to the price appearing on the updated page of the MASHAKEJA.COM site and not on an outdated page to which they might have had access by an Internet search in ‘cache’ mode. Data communicated by the Customer and saved by the MASHAKEJA.COM site when the order is placed constitutes the proof of transactions between Masha Keja SARL and the Customer. After validation of the order by the Customer, Masha Keja SARL will send a confirmation email to the Customer to notify the Customer that the order has been recorded. The price of Products purchased is to be paid cash, in full, on the day that the order is placed by the Customer. Masha Keja SARL shall not be bound to carry out delivery of products ordered by the Customer if the price has not previously been paid in full. Ownership of Products is only transferred to the Customer after full payment of the price by the latter. Transfer of risks of loss and deterioration of the Products will be made after delivery and acceptance of the Products by the Customer. Delivery charges are indicated on the MASHAKEJA.COM site and are inclusive of all extras. These charges are to be paid by the Customer are will be billed as a supplement to the sale price of the Products. Customers will be informed of delivery charges related to their order before the order is made final, and the Customer will be requested to pay the full amount of the purchase.
ARTICLE 4 - DELIVERY
Products purchased by Customers will be delivered within a maximum of thirty days after the order date to the address indicated by the Customer when placing their order on the MASHAKEJA.COM site. If this period is exceeded and not justified by a case of force majeure, the Customer may request that the sale is rescinded under the conditions laid down in Article L. 114-1 of the Consumer Code and obtain a refund of monies paid when the sale was made. Excepting specific cases or the unavailability of one or several Products, Products ordered will be delivered in a single consignment. Deliveries will be made by an independent carrier. Customers are bound to check the condition of Products delivered. Customers have a period of five days as from delivery to lodge, by recorded delivery letter addressed to Masha Keja SARL - Customer Service – 37 rue de chezy 92200 Neuilly sur Seine, France or by email to the following address : firstname.lastname@example.org, any reserves or claims for non- compliance or obvious defect of Products delivered, with all supporting documents or items related thereto. After this time and in the absence of having complied with these formalities, the Products will be considered as compliant and exempt from any obvious defect, and no claims will be accepted by Masha Keja SARL . Masha Keja SARL will replace as soon as possible and at its own cost any Products delivered where non-compliance or obvious defects have been duly proved by the Customer. If a return is made following a delivery error or a request for exchange, any non-compliant Product must be returned, including all accessories, in its original packaging together with the delivery note to Masha Keja SARL - Customer Service – 37 rue de chezy 92200 Neuilly sur Seine - France. Non-compliant Products will automatically be exchanged, subject to availability, or refunded if the Product is not available, within 30 days from the payment made by the Customer. Costs of exchanging non-compliant Products will be paid by Masha Keja SARL.
ARTICLE 5 - RIGHT TO RETRACT
Customers have, in accordance with the law, a cooling-off period of 14 days from delivery of the Products to return them to Masha Keja SARL for exchange or refund, as long as the Products are returned in their original packaging and in perfect condition within ten days of delivery. Sums paid by the Customer, including delivery charges, will be fully refunded by bank transfer to the account indicated to this effect by the Customer, or by cheque within a maximum of 30 days from the exercising of the right to retract. Charges for the return will be paid solely by the Customer. Customers may, if they so wish, where proposed by Masha Keja SARL , opt for another means of refund, in the form of a credit note or voucher in particular. Customers should contact the Customer Service Department in order to obtain a return n° which must then be noted on the parcel. The return should be sent to Masha Keja SARL - Customer Service – 37 rue de chezy 92200 Neuilly sur Seine - France.. The delivery note received with the consignment should be enclosed with the product. The right to retract is subject to the following conditions: a) the return of Products must take place within the times described in this Article, the date appearing on the delivery note being proof relating thereto. b) The Product must be returned in its original packaging, intact, and together with the delivery note. c) the Product must not have been used. d) Any returns by post must be sent by recorded delivery with acknowledgement of receipt, failing which liability for any loss of Products during return transport will not be accepted.
ARTICLE 6 - DATA PROTECTION
In application of Act 78-17 of 6 January 1978, you are reminded that personal data requested from the Customer is required to process orders and destined for internal use by Masha Keja SARL . Customers have therefore a right of access, modification, correction and opposition, since this information concerns them, according to the conditions established by the Act and the regulations in force.
ARTICLE 7 – APPLICABLE LAW - LITIGATION
This contract is subject to French law. Any dispute to which this contract could give rise, concerning its validity, interpretation, execution, termination, the consequences and subsequent related issues will be submitted to the Courts having jurisdiction under the conditions of common law.
